Members of medical schemes can feel relieved as Discovery Health recently won a court case against the Road Accident Fund (RAF). The RAF had issued a directive last year, instructing its offices to stop processing claims from medical scheme members. Discovery Health argued that this was discriminatory. The Constitutional Court refused the RAF's application to appeal and awarded costs to Discovery Health.
The CEO of the RAF maintains that the ruling has no implications for the fund and that their directive still applies. Discovery Health believes that medical scheme members still have the right to claim medical expenses from the RAF. While the ruling doesn't have an immediate impact, it protects members from potential future costs.
Discovery Health and other parties will work to ensure that valid claims are processed and settled for medical scheme members.
